Koncept Evropske agencije za pomorsko varnost (EMSA) kot regulativne agencije izhaja iz konca devetdesetih let 20. stoletja, tako kot številne druge pomembne pobude na področju evropske pomorske varnosti. Agencija EMSA je bila ustanovljena z Uredbo (ES) št. 1406/2002 kot pomemben vir podpore za Komisijo in države članice na področju pomorske varnosti in preprečevanja onesnaževanja z ladij. Njena pooblastila so se z naknadnimi spremembami Uredbe prenovila in razširila.
